Joseph Gauthier, a probationary officer with the Boston Police Department, appeals a lower court's ruling in his suit against the department. Gauthier submitted a urine sample for a drug test, as required by the department's hiring policy. Gauthier posted a positive result for cocaine. The department terminated his employment. Gauthier filed suit when he learned his former supervisor had shared his test results with other cadets.

Both parties file motions for summary judgment. A superior court judge denied Gauthier's motion and ruled in favor of the defendant. Gauthier now appeals

Gauthier loses. The Supreme Judicial Court of Massachusetts affirmed the lower court's decision on all counts.
